Many unanswered questions, and many costly issues. I would be very careful about considering this car without personal inspection. And that is being polite.
I would be curious about the engine number. In one photo the dash is 1940, in another clearly '39. The 39-40 cars are very similar, but for instance, the overdrives totally different, so which one? Front vent windows are clearly 1940. Tstat housing is '40. I suspect '39 front clip on an otherwise 1940 car. The story is quite liberal in explanation...I would suggest letting the car speak for itself. I think the truth is better told by the car than the seller.
My personal opinion is the price is quite ummm...strong....

You might flush out some other options by posting what you are looking for...for example I know of a nice original 40-160 limo that needs a new owner, etc.
